Under the terms of this service agreement, services may not be forgone, skipped, or delayed within the first 12 months of service, or within the first 24 months of service for 24-month agreements, unless under the terms of the money-back guarantee.
Following the initial service, you will receive correspondence notifying you of your upcoming service. In the event that you are not home for either the scheduled services or the initial service, Insight will treat all accessible areas of the premises and you will be charged the full net charge in each month indicated. In the event that either partial or entire property/home are inaccessible, Insight will consider that month's service complete and agrees to return and re-treat inaccessible areas at no additional charge, upon request. Customer is responsible for contacting Insight in order to schedule all follow-up visits, including follow-ups to free re-services.
I understand that this is an agreement for a period of 12 or 24 months, as indicated on this agreement, and that following the initial treatment, at least (1) more seasonal treatment will be performed as per the schedule indicated on this agreement. As one of the terms of this agreement, I agree to pay the initial service charge and the payments thereafter as outlined above. If for any reason, other than under the terms of the money-back guarantee, I am not able to fulfill the terms of this agreement, I agree to early termination charge as indicated on this agreement.
Customer hereby gives authorisation to Insight to provide treatments to the above referenced location, including the application of pesticides, according to the treatment schedule.
Customer hereby authorises Insight to charge the credit card after initial service and on the billing schedule indicated above.
This is an initial 12-month or 24-month agreement, as indicated on this agreement. Service shall continue on the same schedule thereafter until customer advises that they wish to discontinue. If customer fails to fulfill the 12-month or 24-month agreement, as applicable, customer agrees to pay a fee equal to half the cost of one bi-annual billing amount, or if the consumer selects monthly billing, a fee equal to the cost of three monthly billing amounts.

Customer agrees that posting on-site notification in advance of service being rendered is not required. Customer will however receive correspondence notifying them of upcoming service.

In the event of continuous pest activity, Insight agrees to return and re-treat affected areas at no charge. If you are not completely satisfied with results after giving Insight at least two opportunities to re-treat between regularly scheduled services, Insight will refund the last charge and terminate the service agreement with no cancellation fee.

1. Pests to be controlled - see front of Protection Agreement. The only obligation of Insight Pest Solutions Bris CO PTY LTD (Brisbane) / Insight Pest Solutions MEL Co Pty (Melbourne) (hereinafter referred to as COMPANY or INSIGHT) under this agreement is to provide the treatments for pests as outlined and in accordance to the terms and conditions as outlined on the front of this agreement.
1.b) Carpenter ant warranty and treatment. Activity inside as well as around the immediate property of the location as identified on the front of this agreement, shall be covered. COMPANY agrees to treat any carpenter ant activity. If Insight is unable to control and/or eliminate the interior carpenter ant activity if any exists, after no-fewer than 3 treatments within the bi-annual period (6-months) of this agreement, then customer is entitled to stop the service agreement with no fee, and receive a refund for monies paid for the last charge. There shall be no additional charges, other than indicated on the front of the agreement, to treat any carpenter ant activity in the property identified on the front of this agreement, as well as the immediately surrounding property, if the carpenter ant coverage is selected on the front of this agreement.
2. Customer agrees to receive and pay for the treatment outlined on this agreement and to make the premises available to COMPANY to perform such treatments and contain their pets.
3. Future damage, Limitation of Liability
A) This does not guarantee against presence of future insect damage to buildings or contents nor provide for repair or compensation.
B) This agreement does not provide for the control or preventions of termites or any other wood destroying insects, organisms, or any other pest not identified herein, except carpenter ants if the carpenter ant coverage is selected. CUSTOMER expressly waives and releases COMPANY from any liability and/or for any claim for personal injury or damages to the structure or its contents caused by wood destroying insects, organisms or any other arthropods listed or not listed in this agreement.
C) COMPANY does not guarantee against the elimination of bed bugs or against the present or future presence of any other arthropod or pests. COMPANY is not liable for any actual or consequential damages to the property or its contents sustained by the customer as a result of bed bugs or any other arthropods or pests. COMPANY is not liable for any form of repairs to buildings or its contents. COMPANY is not liable for any injury or damages resulting from contact with any product used by COMPANY to treat the premises.
4. CANCELLATION - In order to discontinue service, customer agrees that they will speak to a member of Insight's customer service team either over the phone by calling our offices at 07-4454-1073 (Brisbane) / 03-9968-3111 (Melbourne), or by visiting one of our local branch offices. You may cancel by phone, email, in person, or by completing and returning the Section 82 cancellation notice either before the expiry of the 10-business-day cancellation period or no less than 30 days prior to the next scheduled service. Cancellation prior to the completion of the initial 12-month or 24-month agreement period, as applicable, will result in customer being required to pay an early termination fee as indicated on the front of this agreement if the initial 10 day cancellation period has elapsed. If you cancel this agreement within the 10 day period, you are entitled to receive a full refund for all services rendered, and must return all goods installed at the service premises at no cost to customer.
THERE IS NO CANCELLATION CHARGE AFTER THE INITIAL 12-MONTH OR 24-MONTH PERIOD, AS APPLICABLE. Should customer choose to refuse service either upon arrival of service technician at the premises or less than 30 days before the next scheduled service visit and the INITIAL SERVICE has already been performed AND the 10 day cancellation period has elapsed, customer shall be charged as indicated on this service agreement for that bi-annual period.
THERE IS NO CHARGE TO CANCEL THIS AGREEMENT EITHER BEFORE THE INITIAL SERVICE HAS BEEN PERFORMED, NOR AFTER THE INITIAL 12-MONTH OR 24-MONTH PERIOD, AS APPLICABLE, HAS ELAPSED.
5. SCHEDULE OF TREATMENTS - COMPANY will treat the premises on a quarterly schedule + or - 15 days from the month indicated in the SCHEDULE section on the front of this agreement. COMPANY reserves the right to change the treatment schedule if it becomes necessary, however will advise customer should this occur.
6. DISCLAIMER - COMPANY's liability under this agreement will be terminated if COMPANY is prevented from fulfilling its responsibilities under the terms of this agreement by reason of transportation shortages of fuel and/or materials, strikes, embargoes, fire, floods, quarantine restrictions, natural disasters, or any other act of God or circumstances or cause beyond the control of the COMPANY.
7. Customer agrees to notify COMPANY prior to treatments of any occupants that are allergic or sensitive to the products used. In addition, customer agrees not to tamper, modify, or move pest control devices used for pest control protection.
8. Customer acknowledges that the price of the service provided may need to increase over time, as a result of economic inflation and/or the increased costs of providing the high quality of service that customers have come to expect from Insight. COMPANY agrees that there shall be no increase in price during the customer's initial one-year service term. If COMPANY increases the price of service after the initial one-year service term, COMPANY will send PURCHASER, at least 30 days before the change comes into force, a written notice setting out the new price and the date of the coming into force of the price increase. PURCHASER may refuse the price increase and cancel the contract without cost, penalty or cancellation indemnity by sending the COMPANY a notice to that effect no later than 30 days after the price increase comes into force.
9. Customer agrees that by providing email(s) and phone number(s), Insight is authorized to contact customer by phone, email, and text message regarding upcoming services, invoices, service reports, outstanding balances, and promotional offers or complimentary service offerings. Customer may opt-out from email or text notification at any time by contacting Insight and making request.
UPON REQUEST, COMPANY WILL PROVIDE THE PURCHASER WITH A COPY OF THE MSDS SHEET OF THE PESTICIDE(S) USED TO TREAT THE PREMISES.
